MEMORANDUM
BRIEF IN SUPPORT OF MOTION TO DISMISS
I.
GENERAL
Edwards
is accused of contracting with plaintiff but the evidence provided the Court is
a contract with Direct Merchants Bank located in Jacksonville, Florida.
Neither Direct Merchants Bank nor “Metris Companies LLP is licensed to do business in the State of New Mexico.
II.
ISSUE
Whether
the Court has jurisdiction on interstate commerce disputes.
III.
FACTS, POINTS OF LAW, AND AUTHORITIES
1)
“Metris Companies LLP by and through its counsel, is attempting to put a fraud upon the Court which is covered by
NMA 36-2-17.
2)
“Metris Companies LLP admits being a corporation, which transacts business in interstate commerce.

“Metris Companies LLP has not shown any connection with

ARGUMENT
A
corporation located in Jacksonville, Florida, with no lawful connection to
operate internally within the State of New Mexico, under color of interstate
commerce, lacks standing to bring suit. Further,
Edwards is not chattel property owned by an interstate corporation to do with as
it deems profitable. No contract
exists between Edwards and plaintiff on an intrastate commerce basis where
jurisdiction would lie; this Court does not have jurisdiction on interstate
commerce matters. The proper
jurisdiction is the United States District Court for the District of New Mexico.
V.
CONCLUSION
The
Court lacks jurisdiction in interstate commerce matters.
